These terms and conditions set forth the responsibilities and obligations of you, the Charter party, and forms part of the contract entered into between you and the Company in respect of the shuttle services being provided by the Company:

1. Pricing, Payment and Cancellation.

(a) Payment. Pull payment for the charter service is due and payable at least 14 days in advance of the charter date. Charters booked less than 14 days prior to the charter date must be paid in full at the time of booking. Failure to pay the full payment when due may result in cancellation of your Charter.

(b) ALL PRICES ARE IN CANADIAN FUNDS UNLESS OTHERWISE INDICATED.

(c) Itinerary. Charter pricing is based on the itinerary provided by you to the Company. Although a driver may make reasonable efforts to accommodate changes to the itinerary provided, there can be no assurances that all changes can be accommodated. If, either prior to or during the Charter, you request any change in services that results in an increase in miles or hours to the Charter, an additional charge may be necessary for such additional service. Prices are subject to change based on the final itinerary.

(d) Other Costs. You are responsible for all airport fees, tolls, parking, ferry and entrance fees or other fees incurred during the Charter. These fees will be included in your final invoice.

(e) Driver’s Gratuity. Any driver’s gratuity is optional and is not included in the pricing of the Charter.

(f) Fuel Surcharge. The Company reserves the right to impose a fuel surcharge based upon an increase in fuel prices between the time the Charter is quoted and the charter date. This surcharge will be based soled on the increased cost of fuel and will be calculated on the difference in price per liter and the total number of kilometers required for the trip itinerary.

(g) Driver’s Hotel Room. Driver accommodation is not included in the pricing of the Charter. If a hotel room for the driver accommodation is not provided by you at no charge or the Company, the cost of a single, non-smoking hotel room will be included in your final invoice. DORMITORY ACCOMMODATION IS NOT ACCEPTABLE.

(h) Credit Card. The Company reserves the right to request that you provide it with a valid card guaranteeing the payment of any additional charges payable by you under the contract or these Terms and Conditions..

(i) Cancellation. You must notify the Company of any cancellations. There will be no cancellation fee if the Charter is cancelled more than 30 days prior to the charter date. If the Charter is cancelled less than 14 days but more than 7 days prior the charter date, you will forfeit 10% of the contract price quoted in the contract and the balance of the amounts paid by you will be returned to you. If the Charter is cancelled less than 7 days but more than 3 days before the charter date, you will forfeit 30% of the contract price quoted in the contract and the balance of the contract price will be returned to you. If you do not provide at least 3 days notice of cancellation, no refund will be made.

2. Driver’s Hours:

(a) Driver hours must be in accordance with applicable hours of service regulations. In instances where the driver has exceeded his/her hours of service, he/she must be given 8 consecutive hours off before resuming his/her duties. You will be advised of the driver’s hours of service at the time the contract is entered into.

(b) Easy Trips Vancouver is committed to your safety and therefore our drivers are expected to comply at all times with hours of service regulations. Delays, unplanned stops and detours etc. not described on the tour itinerary or charter contract could place your driver in a non-compliance situation punishable with severe fines and out-of-service orders. It is for
this reason that your driver may not be able to accommodate a request for alterations to the
original itinerary. It is a condition of this contract that the chartering party and its representatives or agents respect and abide by the departure times and travel itinerary as disclosed on this contract. As of January 1, 2007 it is a federal offence in Canada for any person or organization to request, require, or allow a driver to violate the hours of service regulations.

3. Damage Deposit.

Where required by the Company, a credit card deposit will be collected as security for in case of damage to the motor coach, including clean-up after use of beverages on the motor coach. The retention of the damage deposit by the Company from charging you for additional costs for the repair of damage to the motor coach as provided for in paragraph 5 of these Terms and Conditions.

4. Conducts of Passengers.

The Company reserves the right to refuse to transport persons under the influence of intoxicating liquor or drugs or who are objectionable to other persons. Passengers shall not interfere with the driver in the discharge of his/her duties or tamper with any apparatus or appliance on the motor coach.

5. Damage to Motor Coach.

The cost of repairing damage to the motor coach, beyond reasonable wear and tear,
relating from the conduct or actions of passengers on your Charter shall be charged to you and shall be payable as soon as such cost is determined.

6. Arrival Time.

The drivers are carefully selected and have strict instructions to drive at all times at a speed within the limits prescribed by law and compatible with safe operation of the motor coach. All arrival times are approximations only. Unusual road conditions, traffic and weather conditions are beyond the control of the Company and may delay arrival times.

7. Baggage and Parking.
The Company assumes nor responsibility for any personal property. Baggage and all
other personal property will be handled only at the passenger’s own risk. The Company is not responsible for any luggage or personal items left either inside the
motor coach or underneath in the luggage bays. The Company does not assume any responsibility for parking at any location.

8. Equipment.
Buses provided by the Company are thoroughly inspected before being assigned to a Charter to ensure uninterrupted service. If for some reason beyond the control of the Company, a mechanical failure makes it necessary to replace the motor coach may be of
a different type.

9. Waiver of Consequential Damages.
It is agreed by you, and acknowledged by you that the Company would not be providing the Charter services to you without this limitation, that the Company would not be providing the Charter services to you without limitation, deposits or costs incurred by you or your passengers for rooms, meals or admissions arising from delays due to factors
beyond the control of the Company, including delays arising from weather conditions and mechanical failure.

10. Entire Agreement.
These terms and conditions, together with the contract for services to which these terms and conditions are attached, constitute for the entire agreement between you and the Company and supersedes any and all other agreements, either oral
written with respect to the subject matter hereof.

11. **Hours of Service**
– Please be advised that ALL CONTRACTS are based on 10 hours service per day. It is
mandatory itineraries are sent to our office 14 days prior to the departure to review Hours of Service. Should your group require more than 10 hours service per day,
there will be additionally hourly charges at the rate negotiated with the Charter Department prior to departure.
